PTN Connect Buyer Agreement and Privacy Policy

Welcome to PTN Connect, operated by Hang 10 Digital, LLC, a California limited liability company, doing business as Property Trade Network (“PTN,” “we,” “us,” or “our”). PTN Connect is an online marketplace at connect.propertytradenetwork.com where approved buyers may purchase real estate seller lead information for use in their own real estate investment, wholesaling, or related businesses.
By submitting a registration request, creating an account, or purchasing leads on PTN Connect, you agree to be bound by this Buyer Agreement and Privacy Policy (the “Agreement”). If you do not agree, do not register or use the platform.
1. About PTN Connect
PTN Connect is a lead marketplace. We connect motivated home sellers with qualified buyers and investors. PTN does not purchase real estate, make offers on properties, take title to homes, act as a real estate broker or agent, provide legal, tax, or financial advice, or guarantee that any lead will result in a transaction. All negotiations, offers, contracts, inspections, and closings are solely between the buyer and the seller. PTN is not a party to any transaction that follows from a lead purchase.
2. Eligibility and Approval
To register as a buyer, you must:
- Be at least 18 years of age and legally able to enter into binding contracts
- Provide accurate, current, and complete information during registration
- Hold any licenses, registrations, or certifications required by your state to engage in real estate purchasing, wholesaling, or related activities
- Not be subject to any restraining order, injunction, or regulatory action that would prevent you from purchasing or marketing residential real estate
- Not have had a prior PTN account terminated for cause
PTN reserves the absolute right to approve, deny, or revoke buyer accounts at our sole discretion, with or without explanation. Approval is not a guarantee of continued access. We may require additional documentation, identity verification, business entity records, or proof of funds before or after approval.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- Keep your password secure and not share it with any third party
- Notify us immediately of any unauthorized use of your account
- Maintain only one account per buyer entity. Multiple accounts created to circumvent purchase limits, exclusivity windows, or pricing rules are prohibited and grounds for immediate termination
4. How the Marketplace Works
Leads on PTN Connect are sold under one of two models, indicated on each lead listing:
- Single-buyer (exclusive): The lead is sold to one buyer only. Once purchased, it is removed from the marketplace.
- Multi-buyer (shared): The lead may be sold to up to two buyers, with a 24-hour exclusivity window between the first and second sale. After purchase, the lead is hidden from the purchaser’s feed and may be subject to a temporary lockout period.
Pricing, including any time-based discounts, is set by PTN and may change without notice. PTN does not guarantee lead volume, lead quality, lead exclusivity beyond what is stated on the listing, or the availability of leads in any specific market.
5. Buyer Conduct and Lead Use Restrictions
When you purchase a lead, you receive a limited, non-transferable right (exclusive or non-exclusive depending on the model) to contact the seller for the purpose of pursuing a real estate transaction. You agree to all of the following.
5.1 Telephone, Text, and Communications Compliance
By accepting this Agreement, you represent, warrant, and attest that you maintain your own compliance procedures for, and that you will at all times comply with, the federal Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), the Federal Do Not Call Registry, all applicable state Do Not Call laws, the CAN-SPAM Act, and any other federal, state, or local communications laws. You acknowledge that you are solely responsible for obtaining and documenting any consent required by law before contacting any seller, and that PTN does not obtain or provide such consent on your behalf.
Your obligations include but are not limited to:
- Honoring all “Do Not Call,” “Do Not Text,” “Do Not Email,” or “Do Not Contact” requests from a seller
- Not using automatic telephone dialing systems, prerecorded voice messages, or artificial voices without the proper level of consent required by law
- Sending text messages only in compliance with the TCPA, including obtaining and documenting any required prior express written consent
- Calling only during permitted hours under federal and applicable state law
- Including a working unsubscribe mechanism, accurate sender information, and a valid physical postal address in marketing emails
- Scrubbing any list of purchased leads against the Federal Do Not Call Registry and applicable state registries before initiating any telemarketing contact, unless an applicable exemption applies
You acknowledge that a seller’s submission of an inquiry to PTN constitutes an inquiry to the buyer or buyers who purchase that specific lead and does not waive the seller’s rights or transfer broader consent. PTN makes no representation regarding any seller’s prior express written consent under the TCPA, and you remain solely responsible for your own compliance and for documenting any consent you obtain directly. Any TCPA, CAN-SPAM, Do Not Call, or related claim arising from your contact with a seller is your sole responsibility, and you agree to fully indemnify PTN for any such claim under Section 10 of this Agreement.
5.2 Fair Housing and Anti-Discrimination
You will comply with the federal Fair Housing Act, the Equal Credit Opportunity Act, and all applicable state and local anti-discrimination laws. You will not refuse to deal with, decline to make an offer to, or alter the terms offered to any seller on the basis of race, color, religion, sex, national origin, familial status, disability, sexual orientation, gender identity, source of income, or any other protected characteristic.
5.3 Honest Representation
You will:
- Identify yourself accurately and truthfully when contacting sellers, including your real name and business name
- Disclose your role (wholesaler, investor, real estate licensee, end buyer, or other) as required by your state’s laws
- Not misrepresent any material fact about the property, your offer, your financial capability, your intent to close, or your relationship to any third party
- Comply with any state-specific assignment, wholesaling, or real estate licensing disclosure laws (including any state requirement that wholesalers be registered, licensed, or disclose their wholesaler status to the seller in writing)
- Not impersonate PTN, claim to be acting on behalf of PTN, or suggest that PTN is endorsing, vouching for, or guaranteeing your offer
5.4 No Resale, Redistribution, or Aggregation of Leads
You will not, directly or indirectly:
- Resell, sublicense, share, syndicate, swap, or redistribute any lead data obtained from PTN Connect to any third party
- Upload lead data to any other lead platform, marketplace, or aggregator
- Use lead data to populate marketing lists, skip-trace databases, or data broker products
- Scrape, copy, or systematically harvest data from PTN Connect
A lead purchase grants you the right to contact that specific seller about that specific property for your own internal business purposes only. Disposition partners and assigning a contract to an end buyer are permitted only after you have entered into a bona fide purchase agreement with the seller in your own name.
5.5 Data Security and Confidentiality
You will store any lead data you receive in a reasonably secure manner, limit access to your own employees and contractors who need it, and not expose it to public access. If you experience a data breach involving PTN-sourced lead data, you will notify PTN at support@propertytradenetwork.com within 72 hours of discovery.
5.6 Prohibited Conduct
You will not:
- Harass, threaten, intimidate, stalk, or abuse any seller or any other PTN user
- Use deceptive, misleading, or high-pressure tactics that could violate federal or state consumer protection statutes (including but not limited to the California Consumer Legal Remedies Act, the California Unfair Competition Law, the New Jersey Consumer Fraud Act, the Indiana Deceptive Consumer Sales Act, and similar laws in other states)
- Engage in any activity that violates federal, state, or local law
- Attempt to defraud the seller, PTN, or any other party
- Use lead data for any purpose unrelated to a good-faith real estate transaction inquiry
- Reverse engineer, probe, scan, or test the vulnerability of PTN’s systems
- Interfere with the operation of PTN Connect or other users’ use of it
6. Payment, Refunds, and Disputes
All lead purchases are charged at the price displayed at the time of purchase. Payment is processed by our third-party payment provider, and you authorize the charge to your selected payment method.
6.1 Refund Policy
Leads are digital goods delivered immediately upon purchase. All sales are generally final. We may, at our sole discretion, issue a refund or store credit if a lead meets one of the following narrow conditions:
- The seller’s primary phone number and email address are both entirely non-functional (disconnected, invalid, undeliverable)
- The property address provided does not exist
- The lead is a verified duplicate of a lead you purchased from PTN within the prior 30 days
To request a review, email support@propertytradenetwork.com within 7 calendar days of purchase with the lead ID and a clear description of the issue. We are not obligated to issue refunds for, and refunds will not be granted for:
- The seller declining to sell, no longer being interested, or being non-responsive
- The property not matching your buy box criteria
- Disagreements over price expectations or condition
- Title issues, liens, or judgments uncovered during diligence
- Competitive market conditions or another buyer reaching the seller first
- Any reason that depends on the seller’s voluntary action
6.2 Chargebacks
Initiating a chargeback or payment dispute before contacting our support team and allowing a reasonable opportunity to resolve the issue is a material breach of this Agreement and may result in immediate account termination, ban from future registration, and collection action for the disputed amount plus fees.
7. No Guarantees and Disclaimers
PTN CONNECT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PTN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make no warranties regarding:
- The accuracy, completeness, or timeliness of any lead information
- The seller’s identity, motivation, financial situation, or ownership of the property
- The seller’s willingness to sell, willingness to negotiate, or response to your outreach
- The condition, value, marketability, title status, or zoning of any property
- The exclusivity of any lead beyond what is stated in the listing
- The volume, quality, or frequency of leads available in any market or time period
- Uninterrupted or error-free operation of the platform
You assume full responsibility for verifying any information about a lead, the seller, and the property before making any offer, signing any contract, or expending any funds.
8. Intellectual Property
All content, software, source code, logos, trademarks, and materials on PTN Connect are owned by PTN or its licensors and protected by intellectual property laws. You receive a limited, revocable, non-transferable license to access the platform for the purpose of purchasing and using leads in compliance with this Agreement. No other rights are granted, and all rights not expressly granted are reserved.
9. Suspension and Termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of this Agreement
- Conduct that creates legal, regulatory, or reputational risk for PTN
- Complaints from sellers or other users regarding your conduct
- Non-payment, chargebacks, or suspected fraud
- Inactivity for 12 or more months
Upon termination, your right to use PTN Connect ends immediately. You must permanently delete all PTN-sourced lead data from your systems within 30 days of termination, except where retention is required by law. Sections that by their nature should survive termination (including indemnification, limitation of liability, dispute resolution, and intellectual property) survive termination.
10. Indemnification
You agree to indemnify, defend, and hold harmless PTN, Hang 10 Digital, LLC, and their owners, officers, employees, contractors, agents, and affiliates from and against any and all claims, demands, lawsuits, regulatory actions, fines, penalties, judgments, settlements, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of PTN Connect or any lead data
- Your communications with any seller or third party
- Your offers, contracts, or transactions with any seller
- Any TCPA, CAN-SPAM, Do Not Call, Fair Housing, consumer protection, or licensing claim against you
- Your violation of any law, regulation, or third-party right
- Your breach of this Agreement
- Any data breach or security incident on your systems involving PTN-sourced lead data
This indemnification obligation survives termination of your account.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PTN’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO PTN CONNECT IS LIMITED TO THE TOTAL FEES YOU PAID TO PTN IN THE 90 DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
PTN IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Governing Law and Dispute Resolution
12.1 Governing Law
This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws principles.
12.2 Informal Resolution
Before filing any formal claim, you agree to first contact us at support@propertytradenetwork.com and attempt in good faith to resolve the dispute for at least 30 days.
12.3 Binding Arbitration
Any dispute that cannot be resolved informally will be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in San Diego County, California, or remotely if both parties agree, and judgment on the award may be entered in any court of competent jurisdiction.
12.4 Class Action Waiver
You and PTN agree that any dispute will be brought on an individual basis only. You waive any right to participate in a class action, collective action, mass action, or representative proceeding against PTN.
12.5 Exception
Either party may seek injunctive or equitable relief in court for matters relating to intellectual property, account access, breach of confidentiality, or unauthorized use of lead data, without first proceeding to arbitration.
13. Modifications
We may update this Agreement at any time by posting the revised version on PTN Connect and updating the “Last Updated” date above. Material changes will be communicated via email to your registered address or through an in-platform notice. Your continued use of PTN Connect after the effective date of any update constitutes acceptance of the revised Agreement. If you do not agree to a revision, your sole remedy is to stop using PTN Connect and request account closure.
14. Miscellaneous
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of that provision or any other. This Agreement is the entire agreement between you and PTN regarding PTN Connect and supersedes any prior agreements or representations. You may not assign your rights under this Agreement without our prior written consent. We may assign our rights and obligations freely, including in connection with a sale or merger.
Privacy Policy
This Privacy Policy explains how Hang 10 Digital, LLC d/b/a Property Trade Network (“PTN”) collects, uses, and shares information through PTN Connect (connect.propertytradenetwork.com) and the main Property Trade Network site (propertytradenetwork.com).
1. Information We Collect
From Buyers
- Name, email address, phone number, business name, EIN or business registration details, and mailing address
- Buy box criteria, including markets, property types, price ranges, and deal types
- Payment information, which is processed and stored by our payment provider, not by PTN directly
- Login credentials, account activity, and purchase history
- Communications you send to us and our team
- Technical data: IP address, browser type, device identifiers, pages viewed, referrer, and timestamps
From Sellers (which becomes the lead data sold to buyers)
- Name, phone number, email address, property address, and information about the property and the seller’s situation, motivation, and timeline
Automatically Collected
- Cookies and similar tracking technologies (see Cookies section)
- Server log data
- Click and conversion data from advertising and analytics platforms
2. How We Use Information
We use information to:
- Operate, maintain, and improve PTN Connect and our main site
- Verify buyer eligibility and approve or deny accounts
- Process lead purchases and payments
- Match leads to buyer buy box criteria
- Communicate with you about your account, available leads, and platform updates
- Detect, prevent, and respond to fraud, abuse, and security incidents
- Comply with legal, tax, and regulatory obligations
- Conduct analytics and product development
3. How We Share Information
We share information in the following ways:
- With buyers who purchase a lead: Seller contact information and property details are disclosed to the purchasing buyer. By submitting an inquiry to PTN, sellers agree that their information may be shared with one or more buyers for the purpose of being contacted about their property
- With service providers: Payment processors, hosting providers (such as WP Engine), email and SMS service providers, CRM tools (such as GoHighLevel), analytics platforms (such as Google Analytics), advertising platforms (such as Google Ads and Meta), lead distribution platforms (such as Phonexa), property data providers (such as PropertyReach), and similar vendors who help us operate the business
- With legal authorities: When required by law, subpoena, court order, or to protect our rights, property, safety, or the safety of others
- In a business transaction: If PTN is sold, merged, or transfers assets, information may be transferred to the successor entity
- With your consent: Any other sharing with your explicit consent
We do not sell buyer personal information to third parties for their own marketing purposes.
4. Cookies and Tracking
We use cookies and similar technologies for:
- Authentication and session management
- Remembering preferences and cart contents
- Analytics
- Advertising attribution and remarketing
- Spam and fraud detection
You can control cookies through your browser settings. Disabling cookies may impact functionality, including login, checkout, and saved preferences.
5. Embedded Content
Pages on PTN Connect or our main site may include embedded content from third parties (such as videos, maps, or forms). Embedded content behaves as if you visited the third-party site directly. Those third parties may collect data about you, set cookies, and track your interaction with the embedded content. Their privacy practices are governed by their own policies.
6. Data Retention
We retain buyer account information and purchase records for as long as your account is active and for a reasonable period afterward to comply with legal, tax, accounting, and dispute resolution obligations. Lead data is retained for marketplace operations, fraud prevention, and dispute resolution. You may request deletion of your account at any time, subject to retention requirements imposed by law or legitimate business purpose.
7. Your Privacy Rights
Depending on your state of residence, you may have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your information, subject to exceptions
- Opt out of certain types of data sharing or targeted advertising
- Request a copy of your data in a portable format
- Designate an authorized agent to exercise rights on your behalf
- Be free from discrimination for exercising these rights
To exercise any of these rights, contact support@propertytradenetwork.com. We will verify your identity before responding and will respond within the timeframe required by applicable law. Virginia, Colorado, Connecticut, Utah, Texas, and other state residents may have additional rights under their respective privacy laws.
8. California Privacy Rights (CCPA/CPRA)
This section provides additional information for California residents under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).
8.1 Categories of Personal Information We Collect
In the preceding 12 months, we have collected the following categories of personal information:
- Identifiers: name, email address, phone number, mailing address, IP address, account login
- Commercial information: purchase history, lead transactions, payment records (payment card data is processed by our payment provider and is not stored by PTN)
- Internet or network activity: browsing activity on our sites, interactions with email and ads, device and browser data
- Geolocation: approximate location derived from IP address
- Professional or employment information: business name, EIN, business address, buy box criteria
- Inferences: preferences and characteristics derived from the above to match leads to buyer criteria
We do not knowingly collect sensitive personal information from buyers beyond what is described above. We do not collect biometric or genetic information.
8.2 Sources of Personal Information
We collect personal information directly from you when you register, communicate with us, or use the platform; from sellers who submit inquiries through our main site; from our service providers (such as payment processors, identity verification services, property data providers, and analytics platforms); and from publicly available sources.
8.3 Purposes for Collection
We use personal information for the purposes described in Section 2 (How We Use Information) above.
8.4 Categories of Recipients
We disclose personal information to the categories of recipients described in Section 3 (How We Share Information) above.
8.5 Sale and Sharing of Personal Information
PTN does not sell buyer personal information in exchange for money. Seller personal information is disclosed to the buyer who purchases a lead, which is the core service sellers consent to when submitting an inquiry; this disclosure is for the purpose of being contacted about a potential transaction, not for cross-context behavioral advertising. PTN does not share personal information for cross-context behavioral advertising in a manner that would require an opt-out under the CPRA.
8.6 Your California Rights
If you are a California resident, you have the right to:
- Know what personal information we collect, use, disclose, and (if applicable) sell or share about you
- Access the specific pieces of personal information we have collected about you in the preceding 12 months
- Correct inaccurate personal information we maintain about you
- Delete personal information we have collected from you, subject to legal exceptions
- Opt out of sale or sharing of your personal information for cross-context behavioral advertising
- Limit use of sensitive personal information to purposes necessary to provide the requested service
- Data portability in a portable, usable format
- Non-discrimination for exercising any of these rights
8.7 How to Submit a Request
To submit a verifiable consumer request, email support@propertytradenetwork.com or call (855) 758-9955. We will verify your identity using account information and may request additional documentation for sensitive requests. We will respond within 45 days, with one possible 45-day extension if reasonably necessary. You may designate an authorized agent to make a request on your behalf with proof of authorization.
8.8 Retention
We retain personal information for the period necessary to fulfill the purposes described in this Privacy Policy, including legal, tax, accounting, fraud prevention, and dispute resolution obligations, after which we delete or de-identify the information.
8.9 Shine the Light
California Civil Code Section 1798.83 permits California residents to request information about disclosures of personal information to third parties for those third parties’ direct marketing purposes. PTN does not disclose personal information to third parties for their own direct marketing purposes.
9. Data Security
We use reasonable technical and organizational measures to protect your information, including encryption in transit, access controls, and secure hosting. No system is fully secure, however, and we cannot guarantee absolute security.
10. Children
PTN Connect is not intended for anyone under 18. We do not knowingly collect information from children. If you believe a child has provided us information, contact support@propertytradenetwork.com and we will delete it.
11. International Users
PTN Connect is operated from the United States. If you access the platform from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data protection laws than your jurisdiction.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The “Last Updated” date at the top reflects the most recent revision. Material changes will be communicated through the platform or by email.
